Terms of Service

1. Acceptance of the Terms

Welcome to Visual Novel Universe ("the App" or "the Service"), an online platform for creating, distributing, and consuming visual novels. These Terms of Service ("Terms") govern the use of the App and all related services.

Agreement: By creating an account, uploading content, or using the App in any way, you accept these Terms, our privacy policy, and any future policies we publish.

Minimum Age: You certify that you are of legal age to form a binding contract in your jurisdiction. If you are a minor, you must have permission from a parent or legal guardian to use the Service.

2. Account Creation and Use

Registration: Use of core features (UGC creation/publication, comments) requires account registration. You are responsible for maintaining the confidentiality of your password and all activities under your account.

Account Information: You agree to provide true, accurate, and complete registration information (as detailed in our Privacy Policy).

Account Termination: You may delete your account at any time through app settings. We reserve the right to suspend or terminate your account, with or without prior notice, for any violation of these Terms, especially violations of the Acceptable Content Policy (Section 3).

3. User-Generated Content (UGC) and Moderation

This section defines your rules and app moderation, a key requirement for Google Play UGC apps.

3.1 UGC License

Your Ownership: You retain all copyright and other intellectual property rights over the UGC you create and publish in Visual Novel Universe.

Granted License: By publishing UGC on the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, display, and perform UGC in connection with operating and promoting the App.

3.2 Content and Conduct Rules (Acceptable Content Policy)

Users agree not to create, upload, share, or promote content or behavior that:

Illegality: Is illegal or promotes illegal activities.

Abuse and Hate: Contains or promotes hate speech, harassment, intimidation, doxing, discrimination, or violence against individuals or groups.

Explicit Content (Zero Tolerance): Contains sexually explicit content, nudity, pornography, or services intended to be sexually gratifying. Child sexual abuse material (CSAM) has zero tolerance and will be reported to authorities.

Copyright/IP: Infringes copyright, patents, trademarks, trade secrets, or any other third-party intellectual property rights.

Malware/Fraud: Contains viruses or malicious code, or is used for spam or fraudulent activities.

Personal Information: Exposes third-party personal information without consent (e.g., phone numbers, addresses).

3.3 Moderation Mechanisms

Proactive Moderation: We use reasonable moderation methods, both automated and manual, to identify and remove content that violates these Terms.

Reporting System: The App provides an easy-to-use reporting function available next to any visual novel, comment, or user profile. We encourage use of this function to report violations.

Blocking Tool: You can block other users to prevent 1:1 communication, in line with Google Play safety policies.

Disciplinary Actions: We reserve the right to remove, edit, or restrict access to any UGC that violates these Terms, and to suspend or permanently ban the responsible user.

4. Intellectual Property of the App

All rights to the App, except UGC, including code, design, graphics, interfaces, and logos, are property of Tomás de Armas Déniz and Juan Aday Siverio González and are protected by copyright law. A limited, non-exclusive, non-transferable license is granted to use the App.

5. Disclaimer of Warranties and Limitation of Liability

UGC: You understand that by using the App you may be exposed to UGC from various sources and we are not responsible for the accuracy, usefulness, or safety of such content. Use of the App is at your own risk.

Limitation: To the maximum extent permitted by applicable law, Tomás de Armas Déniz and Juan Aday Siverio González will not be liable for indirect, incidental, special, consequential, punitive damages, or any loss of profits or revenues.

6. General Provisions

Indemnification: You agree to indemnify and defend us from any claim or demand (including attorneys' fees) arising from your UGC, your use of the Service, or your breach of these Terms.

Governing Law: These Terms will be governed by and interpreted under the laws of Spain.

Changes to Terms: We may modify these Terms at any time. If a change is significant, we will make reasonable efforts to notify you (e.g., by email or through the App) before the new Terms take effect.
